Legal Complaint Against UDR
Our complaint alleges, among other things, that UDR maintains company-wide security deposit and before-and-after photograph policies and practices that fail to meet the requirements of California Civil Code Section 1950.5.
Specifically, the lawsuit includes allegations that UDR has policies and/or a pattern and practice of:
- Withholding deposits for cleaning and repair charges without providing bills, invoices, or receipts to substantiate those costs were incurred; and
- Failing to provide required photographs of a unit's condition before and after any repairs or cleaning.
The lawsuit further alleges that these practices are not isolated incidents, but the result of standardized policies UDR applies uniformly across its California properties.
More specifically, the tenant security deposit lawsuit, filed on behalf of a former Bella Terra tenant and other similarly situated Californians, was brought in the U.S. District Court for the Central District of California. It names UDR, Inc., United Dominion Realty, L.P., UDR Lighthouse DownREIT L.P., and other related entities as defendants, and seeks damages, restitution, and an order requiring UDR to change its security deposit practices going forward.
Who the Lawsuit May Affect
The lawsuit seeks to represent two proposed groups of former UDR tenants in California:
- Documentation Deficiency Class: Former tenants of UDR's California properties whose lease ended within four years of the filing of the complaint and whose security deposit deductions for cleaning or repairs exceeded $125.
- Photograph Deficiency Subclass: Former tenants of UDR's California properties whose lease ended on or after April 1, 2025, and whose security deposit deductions for cleaning or repairs exceeded $125.
If either of these situations sounds familiar and you rented at a UDR-managed property in California, you may be affected by the issues raised in this lawsuit.
