Mercedes Class Action Lawsuit

Fire Risk Sparks Mercedes Class Actions in California and Nationwide

Daimler AG—the manufacturer of Mercedes-Benz, Maybach, and Smart—issued a letter to tens of thousands of car owners warning of a technical defect that could cause certain Mercedes-Benzes to catch fire. The defect in question lies in a potential leakage in the coolant pump: If this leakage occurs, components may easily heat up and ignite.

Are you one of the over 80,000 people with a defective Mercedes in the driveway? You may have the right to join a class action lawsuit against the manufacturer. Daimler, like any other auto manufacturer, has a responsibility to ensure its vehicles are safe for use before they make it to market. If you have suffered injury or other damages because of Daimler’s negligence, you may be entitled to compensation.

Kershaw Talley Barlow is here to advocate for you.

About 80,000 Mercedes Pose Fire Risk

On January 4, 2022, German newspaper Bild broke the news of the technical defect, and its associated fire risk, in certain Mercedes vehicles. (Since then, Daimler has confirmed the story with Reuters.) All affected vehicles were manufactured over a four-year period, from January 2017 to October 2021.

The following Mercedes-Benz models were deemed defective due to the fire risk:

  • GLE/GLS (167 platform)
  • C-Class (205 platform)
  • E-Class (213 platform)
  • S-Class (222 platform)
  • S-Class (223 platform)
  • E-Class Coupe/Convertible (238 platform)
  • GLC (253 platform)
  • CLS (257 platform)
  • G-Class (463 platform)

Lack of Auto Parts Stalls Mercedes-Benz Fire Risk Recall

Despite the very real fire risk, the affected Mercedes-Benz models have not been recalled due to a lack of parts.

Daimler stated it would implement a recall as soon as it has enough parts to fix the tens of thousands of affected models. Until then, Daimler has warned against using the defective vehicles. If you absolutely must use your Mercedes, the manufacturer warned to drive it “in a particularly prudent manner.”

Have You Been Affected? You Have Legal Rights

When you bought or leased your Mercedes-Benz, you did so under the pretense that it was a safe, reliable, top-tier vehicle. Kershaw Talley Barlow is, therefore, determined to hold the auto manufacturer accountable for failing and endangering consumers.

If a class action lawsuit is successful, class members could recover compensation for their damages, such as those relating to:

  • Property and vehicular damage
  • Medical expenses for fire injuries
  • Pain and suffering from fire injuries
  • Time and money lost due to the fire risk

Our national lawyers are highly skilled in litigating class action suits. In fact, some of our past case results include significant settlements and verdicts won over a range of defective products. When you are going up against a powerful corporation, our award-winning attorneys are here to give you a strong chance of success. We have what it takes to stand up to Mercedes on your behalf.
