California TDF Lawsuits: Case Update

The California Supreme Court Has Ruled in Gilead’s Favor

TDF lawsuits have been concluded. Kershaw Talley Barlow is no longer accepting new clients for these cases.

Tenofovir disoproxil fumarate (TDF) is an HIV medication sold by Gilead Sciences, Inc. under brand names including Viread®, Truvada®, Truvada for PrEP®, Atripla®, Complera®, and Stribild®. At Kershaw Talley Barlow, we represented clients in litigation alleging that Gilead delayed bringing a safer alternative medication, TAF, to market to protect its profits from TDF, despite reportedly knowing that TDF would cause significantly greater kidney and bone injuries than would its safer drug TAF. Our managing partner, Attorney William Kershaw, was appointed by the court as Co-Liaison Counsel overseeing more than 24,000 TDF lawsuits filed nationwide.

Unfortunately, in August 2026, the California Supreme Court ruled in Gilead’s favor in the Gilead Tenofovir Cases, holding that California law did not require Gilead to bring TAF to market sooner, even if the company knew it was a safer drug. As a result of this ruling, TDF claims in California cannot move forward, and our firm is not accepting new clients for this matter.
